Also, as the legal profession has adapted and evolved, so have alternative and more commercial methods of funding.  As a consequence, interest in the costs of legal proceedings by the commercial sector has vastly increased.

Costs issues arising out of matters which are funded through Third Party or Insurance agreements has expanded enormously during the past decade.  Insurers and Third Parties now have an increasingly important role within the profession.

As part of this evolution, the traditional models of funding have also developed.  Whilst the standard retainer can still claim prevalence, the more traditional models of funding legal proceedings can no longer be regarded as the norm.

The costs issues in litigation can be complicated and subject to intense challenge.  Issues such as the validity of funding agreements, liability, success, proportionality – amongst others – are the focus of many disputes that are put before the courts.  The funding of litigation matters by Insurers is worth many millions of pounds and the cumulative issues in dispute, and potential cost saving, can be equally prodigious.
