The Claimant’s Budget totalled £244,676.30; the Defendant’s totalled £79,371.23.

Given the extent of the claim and need for expert evidence, the Court held that the Defendant’s Budget was “erroneous”, while their Precedent R was “completely unrealistic” and intended to ensure that the Court’s allowance of the Claimant’s Budget “will also be low”, and so was “abuse of the cost budgeting process”.

The Court therefore ignored the Defendant’s Budget, holding that the Claimant’s Budget as claimed was reasonable and proportionate.
